Terms of Service

The owner and manager of the web environment YAIKA.COM and its regional domains is Yaika.com OÜ (registry code 1488275, P.O. BOX 281, Narva mnt 1, Tallinn, 10503; e-mail yaika@yaika.com), (hereinafter YAIKA).

1. General provisions

In order to use the web environment you have to agree with the following conditions of use and take account of all the applicable laws and regulations. By entering and using the web environment, you shall agree with the current conditions of use without any restrictions and limitations, and affirm that these prevail over all the previous contracts which have been concluded between you and YAIKA. If you do not agree with all the clauses of the current conditions of use without restrictions and limitations, you are not allowed to use the web environment. YAIKA has the right to change the functionality of the service, menu structures of service use, limitations, procedures and the documentation connected to it without any prior notification. Changes shall be deemed to be communicated to the registered users after adding thereof to the YAIKA web environment. YAIKA has the right to change the Conditions of use unilaterally. Changes shall become effective after they have been posted on YAIKA page for conditions of use or after a notice has been sent to a user’s e-mail. If a user does not agree with the new conditions he/she shall have to stop using the service of YAIKA service immediately. YAIKA is not responsible for the possible damages caused by a user to other users and third parties.

2. Service

YAIKA web environment enables to transfer streaming radio and video in real time for social communication by having video, audio and text conversations and leaving comments (hereinafter the Service). Users are responsible for the content of the video, audio and text conversations and comments created by them, which are transferred during video and radio streaming. YAIKA is not responsible for any video or radio channels or their content added by the users. Using the service is free of charge.

3. User registration

Registration is not required for viewing the public content of the web environment and for try broadcast creation. Registration is required for creating a personal video and radio channel in the Web environment, entering and transferring information and for using several other Services.

The access to the account is limited with a user name and password, which Users can choose when registering as a user of YAIKA. The Conditions of use shall take effect when YAIKA has sent a message about the registration of the user and shall apply without a term until YAIKA’s user account has been deleted. A registered User shall affirm that he/she accepts and adheres to the conditions of use when registering. The registration of the web environment shall apply without a term.

4. User privacy

YAIKA is obliged not to publish the personal information gathered at registration to any third parties. YAIKA shall not use the contact information of registered Users for transmitting information not related to using the Web environment and Users shall not be included in YAIKA’s mailing lists without their approval. Persons under 18 years of age are obliged to ask permission from their parents or guardians before submitting their personal data (on our website, by phone or in other way). In case such permission is not given, it is not permitted to submit any personal data.

5. User rights and obligations

Users are obliged to submit data which are not misleading, inaccurate or incorrect. Submitted data have to be in accordance with good practice. Users are obliged not to send other users such messages, which qualify as junk mail, i.e. messages which would probably not interest the recipients. Users are obliged to adhere to the Intellectual Property Rights Act. The services may not be used for fraud or illegal activities.

Users are obliged to assure that the files entered and the electronic mail do not contain viruses and other computer programs and files which would harm normal functioning of the website in one way or another, or which are automatically saved in the user’s computer, and disturb or damage its normal functioning. Users are obliged to keep the user name and password necessary for entering the website from reaching third parties, unless a registered user has authorised a third person to use his/her user name and password for using the Service. Users have to inform YAIKA of losing of one’s user name and password or falling thereof into the possession of third parties. Users are obliged not to publicly transmit such videos/comments/texts to YAIKA web environment, which do not conform to good practice or are socially inappropriate and illegal.

• Using the content, logos, service marks or trademarks of the site without authorisation or removing trademarks from the materials on YAIKA’s website;
• Using robot programs;
• Collecting personal data (including user names, e-mail addresses, etc.) of other YAIKA users for illegal reasons;
• Entering materials of a third person without his/her written consent;
• Using foul language or insulting other users in other ways;
• Transmitting information with a pornographic content;
• Showing violence;
• Disparaging different religions or beliefs;
• Using drugs, alcohol, and smoking during video or radio air time;
• Promotion of drugs, alcohol and smoking.

6. YAIKA’s rights

YAIKA has the right to prejudice or nullify the rights of a user if the latter violates the current conditions of use.

8. Jurisdiction

In case of disputes between Users and YAIKA the law of the Republic of Estonia shall be applied and the dispute shall be settled pursuant to procedure prescribed by the law of the Republic of Estonia.
